Terms and Conditions for UrbexHunt

Welcome to UrbexHunt. These Terms of Service ("Terms") govern your access to and use of the UrbexHunt platform, including our website (https://urbexhunt.com), iOS app, and Android app (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Scope and Agreement

1.1 These Terms constitute a binding agreement between you ("User") and UrbexHunt ("we", "us", "our").
1.2 By registering for an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms.
1.3 If you do not agree to these Terms, you must not use the Service.
1.4 We may update these Terms from time to time (see Section 12). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Description of Services

2.1 UrbexHunt is a community platform for discovering, sharing, and documenting abandoned locations (Lost Places / Urban Exploration).

2.2 Free Tier: All registered users can browse a limited selection of locations, view community content, and contribute their own places, photos, and comments.

2.3 Pro Subscription: For a monthly fee of EUR 4.99, Pro subscribers gain access to the full database of locations, advanced filters, and additional premium features. Details of included features may change over time and are displayed on our pricing page.

3. Registration and Accounts

3.1 You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration.
3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.3 You must be at least 16 years old to create an account.
3.4 Each person may maintain only one account. Duplicate accounts may be terminated without notice.
3.5 You must notify us immediately at support@urbexhunt.com if you suspect unauthorized use of your account.

4. User Conduct and Rules

4.1 You agree to use the Service in compliance with all applicable laws and regulations.

4.2 You must NOT:
a) Post content that is illegal, threatening, defamatory, obscene, or otherwise objectionable.
b) Upload content that infringes the intellectual property rights of others.
c) Use the Service to promote or coordinate illegal activities, including but not limited to trespassing, vandalism, or theft.
d) Share precise locations of sites where access would constitute criminal trespass under applicable law without clearly marking them as such.
e) Harass, bully, or threaten other users.
f) Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
g) Use automated tools (bots, scrapers) to access the Service without our written permission.
h) Distribute spam or unsolicited commercial messages.

4.3 IMPORTANT — Urban Exploration Disclaimer: UrbexHunt is an informational and community platform. Listing a location on UrbexHunt does not constitute permission or an invitation to visit. Many locations are on private property or are structurally unsafe. You are solely responsible for ensuring that your activities comply with local laws and that you take appropriate safety precautions. We strongly advise against entering any location without the property owner's permission.

5. User-Generated Content and License

5.1 You retain ownership of all content you upload, including photos, descriptions, comments, and ratings ("User Content").
5.2 By uploading User Content, you grant UrbexHunt a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and modify your User Content in connection with operating and promoting the Service.
5.3 This license persists even after account deletion, as your contributions form part of the community database. You may continue to use your content elsewhere.
5.4 You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights.
5.5 We are not obligated to store, maintain, or provide copies of your User Content. You are responsible for keeping your own backups.

6. Content Moderation

6.1 We reserve the right to review, moderate, and remove any User Content at our sole discretion, without prior notice.
6.2 We maintain a zero-tolerance policy for objectionable content. Content that is offensive, illegal, harmful, or otherwise violates these Terms will be removed.
6.3 Users can report content through the in-app reporting feature. We aim to review all reports within 24 hours.
6.4 Violations may result in content removal, temporary suspension, or permanent termination of your account, depending on the severity and frequency of the violation.
6.5 Repeat offenders will be permanently banned from the Service.

7. Subscriptions and Payment

7.1 Pro subscriptions are billed monthly at EUR 4.99 through our payment processor, Stripe. By subscribing, you authorize recurring charges to your chosen payment method.
7.2 Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
7.3 You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
7.4 We do not offer refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access until the end of that paid period.
7.5 We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect. Continued use after the change constitutes acceptance of the new price.
7.6 If a payment fails, we may suspend Pro features until the payment issue is resolved.

8. Intellectual Property

8.1 The Service, including its design, code, logos, trademarks, and non-user-generated content, is owned by UrbexHunt and protected by applicable intellectual property laws.
8.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
8.3 You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Disclaimer of Warranties and Limitation of Liability

9.1 The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
9.2 We do not guarantee the accuracy, completeness, or reliability of any location data, user-submitted content, or other information available through the Service.
9.3 UrbexHunt is NOT liable for:
a) Any personal injury, property damage, or legal consequences resulting from visiting locations discovered through the Service.
b) The accuracy of geographic coordinates, descriptions, or access information.
c) Any interactions, disputes, or arrangements between users.
d) Any loss of data, revenue, or profits arising from your use of the Service.
e) Any unauthorized access to or alteration of your data.

9.4 To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9.5 Nothing in these Terms excludes or limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited under applicable German law.

10. Termination and Account Deletion

10.1 You may delete your account at any time through your account settings or by contacting support@urbexhunt.com.
10.2 Upon account deletion, your profile information and personal data will be removed in accordance with our Privacy Policy. User Content that has been shared with the community (places, photos, comments) may be retained under the license granted in Section 5.
10.3 We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms.
10.4 Upon termination, your right to access and use the Service ceases immediately. Any active Pro subscription will not be refunded for the remaining billing period.

11. Privacy

11.1 We collect and process personal data including your username, email address, payment information, location data, and cookies.
11.2 Our collection and use of personal data is governed by our Privacy Policy, available at https://urbexhunt.com/legal/privacy, which forms an integral part of these Terms.
11.3 By using the Service, you acknowledge that you have read and understood our Privacy Policy.

12. Changes to These Terms

12.1 We may modify these Terms at any time. When we make material changes, we will notify users via email and/or an in-app notification.
12.2 The updated Terms will indicate a new version number and effective date at the top of this document.
12.3 If a change materially affects your rights, you will be asked to re-accept the updated Terms before continuing to use the Service.
12.4 If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

13. Final Provisions

13.1 These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
13.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
13.4 These Terms, together with our Privacy Policy, constitute the entire agreement between you and UrbexHunt regarding the Service.
